The Insolvency and Bankruptcy Code, 2016 (Code) which came into force in May 2016 has undergone various changes in the recent past including the passing of Insolvency and Bankruptcy Code (Second Amendment) Act, 2018. Various changes have been made in Rules and Regulations from time to time . The Board has also issued Circulars and Clarifications from to time to give clarity on matters of concern . An attempt has been made to present the section wise commentary on the Code in a simple language as amended by the Insolvency and Bankruptcy Code (Second Amendment) Act, 2108.
HIGHLIGHTS OF THE BOOK
Division I
(1) The presentation of the section wise commentary is in BULLET FORM, unlike conventional form of commentary which runs in paragraphs.
(2) The commentary starts after every section under the head ‘Guide Notes’ which is further divided in various sub heads such as ‘Overview ’of the section supported by Land Mark judgments by Supreme Court / National Company Law Tribunal ( NCLT) / National Company Law Appellate Tribunal (NCLAT), Relevant Rules and Regulations, Circulars and Clarifications, Punishment, etc., in order to give a complete picture of the section at one go.
(3) Supreme Court judgments and National Company Law Tribunal / Appellate Tribunal orders have been placed separately to provide a quick glance on the rulings given for a particular section.
