India is the second-largest producer and consumer of tobacco in the world, with related deaths expected to touch 1.5 million by 2020. Tobacco use is, thus, the biggest global and national public health threat of our times. Against this backdrop, Public Health, Tobacco and Trade in India presents an analysis of the international, constitutional and legal regimes on public health and trade to assess their impact and influence on the right to health as enshrined in the Constitution of India. It highlights and explains the significance of the World Health Organization (WHO) as an instrument of international health law and its importance in relation to the health exceptions under various WTO agreements.
