Mis-selling and poor advice are recognised as inherent risks for the investment services industry. This timely monograph focuses on the sale of complex investment products to corporate retail investors whilst considering the widespread mis-selling of interest rate hedging products (IRHPs) to these investors in the United Kingdom and beyond.From an assessment of past regulatory reforms and planned regulatory initiatives as well as by carrying out an analysis of the conclusions reached by the English judiciary in IRHP mis-selling cases the book argues that corporate retail investors are in a vulnerable position and are hence exposed to a heightened risk of mis-selling. This conclusion is further supported by insights emerging from behavioural law and economics theories. Furthermore the book proposes a range of ex-ante and ex-post regulatory reforms to the investment services regime that aim to balance out the position of corporate retail investors vis-à-vis investment firms.This book aims to make a substantial contribution to the relatively understudied field concerning the different degrees of investor protection mechanisms applicable to individual retail investors as opposed to corporate retail investors and seeks to address these discrepancies through proposed legislative and regulatory reforms.
