Building on existing trends this innovative study interprets Nazi criminal law as a racist nationalist and totalitarian construct which naturally developed from the anti-liberal tendencies of the German criminal law of the Weimar Republic. This interpretation is borne out by the systematic analysis of relevant texts. It also shows how the sytem was received in Latin America underlining its continuity. This challenges the notion that the criminal law of the Nationalist Social regime was unexpected and unrelated to anything that preceded or predated it. It gives an important new perspective to legal historians of one of the darkest historical periods.
