Bloomsbury Publishing PLC The Rule of Law in the European Union: The Internal Dimension by Dr Theodore Konstadinides
The rule of law is closely connected to two other concepts: the separation of powers and the laws equal application within states. In its broader meaning it underpins the existence of fundamental rights ensuring that they are observed and protected and in this respect the idea has loomed large in the development of the EU. However leaving theory aside its practical application may be said to lack substance. It is unclear for instance iwhose/i idea of the rule of law the EU is committed to. It is also uncertain whether it is in fact a new hybrid rule of law based on commonly accepted standards. As EU competence expands the EUs abstract commitment to the rule of law has an immense impact not only EU Member States governments and partner international organisations but also the individual. This book explores how the EU has adopted the notion of the rule of law initially a national construct and how it has transformed it monitored its application and exported it to its Member States and international partners. In a nutshell it provides invaluable insight into the Europeanisation of the rule of law and its reinforcement at the domestic and international level.
