Tied aid is aid granted to developing countries on condition that goods and services for the aid-financed projects are purchased from the donor country; the recipient country has no choice but to fulfil the condition imposed by the donor. However economists have shown that tying aid is undermining leading to higher costs for the goods and services purchased and the distortion of the nature of the aid. Further tying aid frustrates aids potential in fostering trade between developing countries -in many of these countries public bodies and in particular aid-financed projects are major potential outlets for trade between neighbouring states. Tied aid has been extensively discussed in the economic literature but there is little written on its legal aspects; this book therefore fills a major gap in the literature. It is the first legal treatment of tied aid examining in detail the compatibility of tied aid with EU and WTO law and through case studies from the UK Italy the EU and the US the workings of the aid projects and aid procurement systems of donor countries granting bilateral aid.The book will be of interest to academics NGOs and practitioners working in public procurement and development.
